>> good morning, welcome to mornings on 2. it is sunday, april 21. >> another warm day shaping up here in the bay area. so let's go straight to rose rosemary. >> it will be warming, maybe 15 degrees above the seasonal norm as we get into the afternoon. this morning we are mostly clear. ha few patches of fog along the coast. that's about it. cool conditions out there. widespread 40s to mid 50s outside right now. but, i do expect anywhere from 3 to 6 degrees of warming for yesterday's highs and in the extended forecast come the hottest days. i'll show you that forecast. i'll show you the numbers for today coming up. and we begin with an overnight shooting at a south bay bar. it happened around 2:00 this morning in the parking lot of the fiesta nightclub on monterey highway. officers are investigating the possibility an argument inside the establishment spilled outside as the club was closing.

the gunman drove up and fired several rounds into the victim's car. there were five people in that vehicle. police say it's amazing nobody was hit. the victims were able to drive a short distance away and call for help. there are no suspects or arrests at this time. new this morning, a man has been rushed to the hospital after another overnight shooting in san jose. it happened early this morning near stowe avenue. police have not released information on the circumstances of that shooting. the man's condition is not known. also new this morning, a man is recovering after being shot in a robbery attempt in oakland's rock ridge neighborhood. ktvu channel 2 report, alex savage is live to explain what happened and what led to the shots being fired near college avenue. alex. >> well, good morning,eric. this is certainly an unsettling crime for people who live here in the rock ridge area. a lot of people we talked to describe this as a safe neighborhood and the kind of neorhood where people do a lot of walking. often, it's to and from college avenue where all the shops and

restaurants are. it's a block up from where we are this morning. a man and woman walking along the 5300 block of manilla avenue. oakland police say someone with a gun tried to rob the pair. for some reason, that person opened fire on the man hitting him in the left shoulder. that robbery victim, potential robbery victim was rushed to the hospital, but is expected to survive from that gun shot wound. the shooter took off and didn't end up stealing anything from the two. now a short time ago, we caught up with the man who lives in this area as he was walking to work and he told me this kind of violent crime is unusual in the rock ridge area, but not unheard of. >> it's a nice neighborhood and even though it's a nice neighborhood, you have to be careful. there's always that thing out there and walking to work, i always watch out. it happens every once in a while around here. it is upsetting, but it happens. be careful. >> so far, oakland police

haven't put out a description of the shooter they are searching for. i have reached out to a department spokeswoman. i am hoping to hear back and gather more details on this crime that took place last night. one of the questions here, one of the things we are trying to find out and understand is exactly why this shooter opened fire on that robbery victim last night. live this morning in oakland, ktvu channel 2 news. >> now to our continuing coverage of the boston marathon bombings. this morning the accused killer, dzhozkar tsarnaev, remains in the hospital in serious, but stannel condition. he's heavily se dadded with a tube down his throat, unable to speak. when he's able to talk and be interrogated, his uncle hopes he'll come clean. >> i am relieved that he is alive, first of all, for there's a chance to find out who was behind this.

and how he could get involved. >> cnn reports that tsarnaev will face federal terrorism charges and face state murder charges. some lawmakers want him declared an enemy combatant. massachusetts governor says it's time to look forward. >> we, as a boston and a commonwealth community are going to rebound and rebuild. >> investigators are still looking into the background of the older brother, tamerlan, and his possible links to militant islamists. whether the brothers received operational plans from a militant group in the chechnya area. we'll have more on that coming up at 7:35. now for more on the boston bombings, you can go to our website where we have a special section on details. go to ktvu.com for our continuing coverage online. plus, later in this newscast.

infrared images of dzhokhar is coming up at 7:31. how these black and white pictures kept police safe. as the bombing suspect lies in a hospital bed. a legal debate is brewing over the charges they should file against him. katie is live to explain what those charges may be. >> as you mentioned, justice department officials told cnn dzhokhar tsarnaev is facing federal terrorism charges and state murder charges. preliminary hearing could happen in the next 30 days. a lot hinges on when the suspect is well enough to speak. investigators are eager for him to talk so they can find out who planned the attack. tsarnaev will likely be appointed a federal public defender. for now, the justice department is invoking something known as a public safety exception. this rule is used to question terrorism suspects without reading them miranda rights. the rule was created to question terrorists about other

potential threats. senator carl leven says so far there's no connection between the suspect and terrorist groups. leven said to hold him under these circumstances would be contrary to our laws and jeopardize our effort to prosecute him. during interviews before suspects are read their rights is often not admissible during the trial. the issue on miranda rights is further complicated because the u.s. is a u.s. citizen. many of the rules cannot be used on americans. live in the newsroom, katie utehs. ktvu news. people are in texas are being allowed in their homes. curfew is still in effect and there is limited water and electricity. many are still trying to learn the condition of family and friends hurt in the explosion. >> it's really hectic, but we are patient because we know the extent of damage on the other

side. and we got friends and family that we don't know about over there. >> 14 people died in the fertilizer plant explosion, including 11 emergency responders. 200 more were injured. this weekend, texas is also remembering the deadly raid on the branch compound in waco. 76 people died in a fire twenty years ago following a raid on the compound. waco and west, texas, are twenty miles apart. we'll have a look at the events that led up to the attack on a second look tonight after the 10:00 news on ktvu. new this morning, power has been restored to more than 1600 pg&e customers left in the dark by on outage. 1,657 customers lost power around 3:30 this morning when a wire went down. power was restored about an hour later and pg&e is looking into the cause of the outage. also, new this morning we are just getting reports into our newsroom of a shooting in san francisco. firefighters responded to

isn't that a beautiful shot? we have the golden sunshine off the bay this morning. our warming trend continues for your sunday afternoon. five snowboarders have died in colorado's deadliest avalanche in five years. it happened yesterday afternoon near loveland pass. authorities say six snowboarders were on the almost 12,000 foot high pass when all of a sudden the snow gave way. >> they triggered a slide. at least one of them was able to bail off to the side and partially buried. he was able to get himself out and call for help. >> authorities say the avalanche was 600 feet wide and 8 feet deep.

right now authorities say the avalanche danger in colorado is at a 30 year high due to a lack of snow. the death toll is climbing this morning from a devastating 6.6 earthquake in china. officials say the quake left at least 180 people dead and more than 11,000 injured. tens of thousands spent the night in tents and cars as aftershocks continued to rock that region. the quake triggered landslides that cut off roads and disrupted communications in the mountainous county. protests continue in india over the reported rape and torture of a five-year-old girl. people being surrounded near the police station yesterday following the arrest of a 24- year-old man for the crime. the girl's father says she had been taken by a neighbor and held captive in his apartment for two days. the protests come after allegations the police did not properly handle the case. police did not follow up when they reported the girl missing as officers offered them money to go away. this morning, defense secretary

is in israel for the first stop of his week-long mideast trip. it's his first mideast visit as defense secretary. he will talk about serious civil war and the nuclear program. he will talk about u.s. arms deal with israel. this morning israel and the u.s. are both focused on preventing iran from getting a nuclear weapon. and john kerry is wrapping up a trip to istanbul. to push ahead with mideast peace efforts. he also announced a new $100 million aid package that will assist fighters. secretary kerry says the additional money will double the nonlethal assistance to syrian opposition. it will increase aid. secretary kerry says the situation in syria is at a critical moment and the bloodshed needs to stop. the united nations estimates the fighting killed more than 70,000 people and they are asking the syrian president to

step down. more than a decade after the september 11 attack on the world trade . crews started sifting through the debris at the beginning of the month. since then, more than two dozen human remains have been found. more than 2700 people died at the world trade center on september 11, 2001, but only 1600 people have been identified so far. north carolina's governor ordered flags being flown at half staff in honor of seven marines that died. a memorial service will be held tuesday. the announcement is reversal from the governor's initial decision to not lower the flags. he originally said there was no precedent for lowering flags for tragic military accidents. prosecutors in the movie theater massacre hope to use his own words against him.

he faces 166 counts stemming from last july's mass shooting. 12 people were killed and 70 otherrings injured. prosecutors are building a death penalty case against him. they want to use jailhouse video and audio recordings to establish his state of mind and disprove any insanity claims. he is scheduled to go to trial next february. police are searching for two people who opened fire at a marijuana festival in denver. three people were hurt, but are expected to survive. if you check out this video, the chaos erupted as tens and thousands of people started running from that denver park where that festival was being held. you heard those shots and really just saw this aftermath. as many as 80,000 people were expected at that event, marking the date, 4/20 and the passage of laws legalizing marijuana in colorado and washington state. >> there was a lot of people running. lots of people had different

ideas of what was happening. some people were yelling explosion. some people were yelling gun shots. >> police are asking festival goers for the pictures and videos. two bay area lawmakers say they are not giving up on gun control. >> i think wednesday in washington, d.c. essentially was a betrayal of the american people with what went down. >> it's the first -- >> representative anna eshoo and mike thompson held a town hall meeting yesterday in palo alto. people on both sides of that debate showed up. thompson's bill will require extensive background checks, something that not everyone agreed with. >> if i want to protect myself with a firearm, there are so many things in the way for me to be able to protect myself. >> newtown lit a fire under americans. i don't think anyone is going

to give up. >> at meeting, thompson said it will be john boehner to decide if the issue of gun control will be taken up in the house. mark kelly is expected to talk today. kelly is the former commander of the space shuttle endeavor's last mission. you may know, he became a gun control advocate after his wife, former arizona representative, gabrielle giffords was injured in tucson. the convention of the community colleges is being held at san francisco. >> on to sports now. the golden state warriors are crossing their fingers they won't lose one of their best players. the warriors lost to the denver nuggets in a heartbreaker yesterday. 97-95 in the first game of the opening round of the playoffs. tied the game with a three pointer, but andre miller won the game at the last second with a drive to the basket. >> we fought hard to the end. one big play by andre miller changed the game, so we feel

for one day, a six-year-old -- he has sickle cell disease. recently the make a wish foundation reached out to

darias said if his greatest wish was granted, he wanted to be a police officer. with the help of the phoenix police department, darias became an officer for the day, riding in a helicopter and learning how to arrest people. his mother says his experience is inspiring him to keep fighting. >> he might pay attention more to drinking his water, taking care of his health so he can volunteer, you never know. anything could happen. he might be able to be one. >> the day ended at a mock crime scene where darias arrested people who kidnapped his brother. target stores are giving away more than 1 million free reusable bags for earth day. the bags will be filled with $40 worth of products and 250,000 of those bags will have samples of earth friendly products inside. tomorrow, a plastic bag ban begins in pacifica under the reusable bag ordinance. retailers will no longer provide customers with plastic bags. the ban does not apply to

injured. many runners wore black ribbons as a tribute throughout the race. race organizers are donating $100,000 to one fund boston, the relief effort set up by the state of massachusetts. >> very proud the other runners from the united states running here and i think it will be an emotional time for me as well. >> several hundred additional police officers provided security for the event. officials say participation was down this year due to concerns about safety. and back in massachusetts, questions remain over whether the boston bombings were part of a larger conspiracy. yesterday federal agents arrested two foreign nationals on immigration violation in the city of new bedford. that's an hour outside of boston and where dzhokhar tsarnaev once lived. >> he's a nice kid, talked to me last year. came over, played video games with the guys. >> homeland security detained

three people in new bedford on friday. they were questioned and later released. family and friends remembered an m.i.t. police officer killed after the boston marathon bombings with a candle light vigil. hundreds of people, including law enforcement officers turned out for the vigil in wilmington, massachusetts. collier was shot multiple times thursday night as the bombing suspects tried to avoid capture. he was just 26 years old. [ ♪ at the twilights last gleaming ♪ >> emotions were high as the red sox took to the field. first responders took part in a special pregame ceremony to remember the victims and the heros of the week's events. the team wore their white jerseys with the word, boston, on the front. those are going to be auctioned

off. as you know, these were the first pictures we got of the brothers accused in these bombings. pictures that started a massive man hunt. we have new pictures of how that man hunt ended. police released these infrared images. they allowed officers to see through the tarp that covered the boat where 19-year-old dzhokhar tsarnaev was hiding. officers fired warning shots and because there were fears of explosives, a special police vehicle went in to remove a tarp. police eventually fired a flash bag grenade to stun him, and walking out of the boat and getting arrested. he was bleeding with gun shot wounds to the leg and the neck and cbs is reporting the investigators are trying to figure out if the neck round was an attempt to commit suicide. the uncle of the suspect says the older brother, tamerlan, likely convinced his younger brother to take part in the boston marathon apack. while the feds investigate foreign terror links, the uncle

believes the older brother was radicalized by local. a night on the town nearly took the lives of a couple in the east bay. alex savage is life in oakland. >> it turned into a shooting and it happened just a block off college avenue. busy college avenue, which is up that way from us. here on the 5300 block of manilla avenue. they feel safe walking around this neighborhood. it's the kind of place where people watch out for each other and they have a strong neighborhood watch association. it was last night around 9:30 when a holdup turned violent. one of the victims was shot. someone tried to rob a man and woman at gunpoint and for whatever reason, that armed robber opened fire on the man, hitting him in the left shoulder. he was rushed to the hospital, but we understand he is in stable condition and is expected to survive.

for people who live in this part of oakland, this violent crime is very unsettling and one man i talked to said you always have to stay aware. >> that's usually what happens. we used to serve dinner, but it gets dangerous around here at night because people aren't aware and they get caught offguard and that's a bad thing. >> police say the shooter in this case took off and didn't end up stealing anything from the pair. so far, oakland police haven't put out a description of the person they are searching for this morning in connection with this crime. but i have reached out to a department spokeswoman. we are hoping to hear back at some point later on this morning. as soon as we learn details, we'll pass those along to you. live in oakland, ktvu channel 2 news. there is one less law enforcement agency patrolling. a deputy was shot in the foot while making a traffic stop last month in oakland.

the two sides disagreed over who should pay future worker's compensations cases. >> it's a risky job and they need to be medically covered for events just like this. >> the deputies targeted high crime areas, helping police handle drunk driving, traffic stops, and prostitution. oakland says the chp will help the patrols. little league games will return tomorrow. parents and little league officials made the decision to resume the game yesterday. the incident happened on wednesday during a t-ball game. the parent of a player got into an argument with another man and shots were fired in the parking lot. luckily, no one was hurt. according to the harold, the family involved in that shooting has withdrawn from the league. a landmark east bay movie theater will play its final film tonight. opened in pleasant hill in 1967. developers plan to replace it with a sporting goods store.

a hearing is set for next month. the developers gotten a permit to tear it down. the sporting goods store is expected to open at that location in ten months. after years of pink slips, more teaching jobs could be opening up in samona county. more than 36% of the county's teachers are near retirement age. the school district also has more money because of proposition 30. and that combination could mean more job openings in the future. yesterday, samona state university held it first job fair for teachers in more than a decade and more than 100 people attended. the dmv is asking for the public's opinion on driverless cars. google has been testing the vehicles on bay area roads for several years. you have probably seen them out there. the cars are expected to become available to the public and the dmv is trying to decide how best to regulate them when that happens. the new cars raise questions for the dmv, such as who is at fault if the driverless car gets into an accident. the ac transit board of directors will consider holding

off on a fare increase this was supposed to take effect this summer. fares were expected to go up on july 1, but the board now thinks a fare increase could result in a small drop in ridership. the board is scheduled to meet this wednesday. after a year of construction, the new river bike trail in san jose is ready for bike riders. the 6.7-mile trail officially opened yesterday. it runs from virginia street in san jose out. the $3 million project was paid for by federal funds. >> three people are facing dui charges after being arrested at a check point in santa rosa. two check points were set up last night. another at college avenue. police say more than 500 cars went through last night's check points. it's the fifth of many dui check points that will be conducted throughout the year. this morning, firefighters are gaining an upper hand. east of los angeles.

understand. this is a neighborhood where people do a lot of walking. that's why last night's shooting was unnerving. we understand that the shooting and the attempted robbery happened right here on this block. the 5300 block of just a block off of busy college avenue where a lot of people go to restaurants and other stores and shopping areas that are up that way. everything happened about 9:30 last night. this was a robbery attempt that turned violence. when one of the victims was shot. oakland police say that someone tried to rob this man and woman at gunpoint and for whatever reason, that armed robber then opened fire on the man hitting him in the left shoulder. he was rushed to the hospital, but is expected to survive according to police, he is in stable condition this morning. now one man who lives here in the rock ridge area and lived here for a long time tells me that this crime is a good reminder that you have to be aware when you are out and about. >> you were saying there was a shooting last night will make

police say the gunman drove up and fired several rounds into the victim's car. the driver side doors of the suv, as you can see, were riddled with bullet holes. police say there were five people inside that vehicle and no one was injured. they were able to call for help. there have been no arrests at this time. another overnight shooting in san jose. this one happened early this morning near stowe avenue. police have not released information on the circumstances of the shooting and the man's condition isn't known. now to our continuing coverage of the boston marathon bombings. investigators are anxious to talk to the 19-year-old suspect, but they will have to wait. this morning accused killer, dzhozhar tsarnaev, remains in the hospital in serious, but stable condition. he is heavily sedated with a tube down his throat and unable to speak. when he's able to talk and be interrogated, his uncle hopes he will come clean. >> i am relieved he is alive,

in what officials are calling colorado's deadliest avalanche in five decades. it happened yesterday afternoon near loveland pass about 50 miles west of denver. authorities say six snowboarders were on the almost 12,000 foot high pass when all of a sudden snow gave way. >> they triggered a slide. at least one of them was able to bail off to the side and partially buried. he was able to get himself out and call for help. >> authorities say the avalanche was about 600 feet wide and 8 feet deep. right now, authorities say the avalanche danger in colorado is at a 30-year high due to a lack of snow. this morning, some people in the town of west texas are being allowed back in their home for the first time since the deadly fertilizer explosion. a curfew is in effect. many are still trying to learn the condition of family and friends hurt in that explosion. >> it's really hectic. we are patient because we know the extent of damage on the other side. and we have friends and family

that we don't know about over there. >> 14 people died in that fertilizer plant explosion, including 11 emergency responders. 200 more were injured. this weekend, texas is also remembering the deadly raid on the branch compound. 76 people died in the fire following a raid on that compound. waco and west texas are just 20 miles apart. we will have a look at the event that led up to the waco attack tonight after the ktvu 10:00 news. the death toll is climbing this morning from a devastating magnitude 6.6 earthquake in china. the quake has left at least 180 people dead and more than 11,000 injured. aftershocks continue to rock the region. the quake also triggered landslides that cut off roads and disrupted communications. this morning, defense secretary, chuck hag hagel is in israel. hagel arrived a few hours ago.

more than a decade after the attack on the world trade center on september 11. more possible human remains are being found. yesterday workers found another possible set of remains in the debris. crews started sifting through the debris at the beginning of the month. since then, more than two dozen potential human remains have been found. more than 2700 people died at the world trade center on september 11, 2001. only 1600 people have since been identified. north carolina's governor ordered flags flown at half staff in honor of seven marines who died in a training explosion. a memorial service for the

remembered an m.i.t. police officer killed after the boston marathon bombings. hundreds of people, including law enforcement officers turned out for last night's vigil in sean collier's hometown in massachusetts. he was shot thursday night as the bombing suspects tried to avoid capture. he was just 26 years old. new photo surfaced of two of the victims. this picture was taken in 2010. officer collier is on the right. he was posing with transit police officer, richard donahue. donahue suffered injuries after getting shot on friday. ♪ at the twilights last gleaming ♪ >> emotions were on high as the boston red sox took the field for their first home game since the bombing. first responders took part in a special pregame ceremony to remember the victims and heros

attempt. ktvu channel 2 reporter is live with what police are saying about that shooting in that normally quiet neighborhood. alex. >> well, good morning. a few minutes ago, i talked with the head of a crime prevention group and this violent heldup should be a reminder to people that rock ridge is not immuned from crime. the shooting happened on the block where we are standing this morning. this is the 5300 of manilla avenue. a lot of people walk over to restaurants and stores. it was last night at about 9:30 when oakland police say a man and woman were held up on gunpoint. for some reason, that armed robber opened fire on the man, hitting him in the left shoulder. that victim was rushed to hospital, but he is in stable condition and will survive. i talked a short time ago with the head of the neighborhood crime prevention council. he tells me this is the first shooting he could remember in this area in the last ten years

oakland, alex savage, ktvu channel 2 news. the shooting in san francisco that we first told you about. san francisco police tell ktvu they were responding to calls of a shooting on middle point road when they saw a car driving erratically just after 6:30 this morning. officers pulled over that car and saw one of the passengers had a gun shot wound to the upper body. so far, no word on the victim's condition or what led up to the shooting. a coast guard is expected to return after a three month deployment to the eastern pacific ocean. the cutter will return after a 91 day deployment for counter drug operations off the coast of california. in january, law enforcement crews on the cutter seized more than 2100 pounds of marijuana. three suspects were arrested. today, furloughs are set to go into effect for air traffic controllers, which could cause airport delays. the furloughs are a result of the sequester. the airline industry says there could be cancellations and delays of up to two hours after

some airports. airplane traffic controllers will be furloughed one day every other week. a pilot's union filed a lawsuit to stop those furloughs. the court is expected to respond later this week. so if you are flying out of sfo, be prepared for possible delays. one of the main runways is closed and it closed at 10:00 friday night for continuing work and it's not going to open until 8:00 tomorrow morning. so that is likely to slow arrivals and departures. >> if you are heading out of town, you are probably going back east or the midwest where they had an extended winter. >> it is some of the best. except for that whole no rain thing. it looks like we are dry and hot. it's really hard to gripe about the weather we are experiencing, but we sure could use some rain. i don't see any in the extended forecast, unfortunately. outside our doors right now, if you have plans to be outdoors, it's a great day. a bit of a cool start earlier this morning, but those temperatures already rebounding.

welcome back. a sweeping view over the bay area this morning. a few patches of fog to start the day. mostly sunny skies. and a warming trend for your afternoon. this morning, torrential rain caused dozens of rivers to over flow their banks in six midwestern states. flood waters have forced hundreds of people to evacuate and close countless roads. rising rivers have shut down barge traffic and most of an upper mississippi river and closed two mississippi river bridges. homeowners in mansfield, georgia, are cleaning up a big mess after a tornado touched down there. the twister left a path of damage, about 7.5 miles long in the town ripping off roofs and

toppling trees. >> communities come out and help everybody. it's been an outpouring of love. >> one woman was hurt after she was trapped in a mobile home during that storm. hundreds of cars still unclaimed after superstorm sandy will be auctioned off in new york. officials say the cars are flood damaged, but may be salvageable. most of the proceeds will go to the city. more than 3300 cars were towed in the days following the late october storm, which swamped lower manhattan. happening now, a church service for the victims in the boston marathon bombings. several minutes ago, we showed you live picture of the service at boston's cathedral of the holy cross. there it is now. let's take a listen.

>> the proceedings just getting started there in boston for that service. paying tribute to the victims of last monday's bombing. the service was held, is being held at the cathedral of the holy cross. a memorial service was held last thursday morning. it included president obama and the first lady. this morning, police are searching for two people who opened fire at a marijuana festival in denver. terrible video, as you see people running. three people were hurt, but expected to survive. chaos erupted at tens and thousands of people ran from the denver park where the festival was being held. as many as 80,000 people were expected at that event marking the day 4/20 and the passage of laws legalizing laws in washington state. >> there was a lot of people running. lots of people had different

ideas of what was happening. some people yelling gun shots. >> police are asking festival goers for their pictures and video as they search for the person responsible. they do not have a motive for that shooting. closer to home, there's one less law enfor me to say agency paroling oakland streets. oakland sheriff deputies stopped assisting last night. the relationship between the county and city soured after a deputy was shot in the foot while making a traffic stop last month in oakland. the two sides disagreed over who should pay future compensation cases. >> it's a risky job, and they need to be medically covered for events just like this. >> the deputies targeted high crime areas helping police handle drunk driving, traffic stops, and prostitution. oakland says the chp will help those with those paroles. asking for the public's opinion on driverless cars. google has been testing the cars for several years and at some point, those cars are

expected to become available to the public. the dmv is trying to decide how best to regulate them. the new cars raise new questions for the dmv, like who is at fault if a driverless car gets into an accident? the ac transit board will consider holding off on a fare increase that was supposed to take effect this summer. fares were expected to go up to $2.25, but a fare increase could result in a drop in ridership. after a year of construction, the new river bike trail in san jose is ready for bike riders. the 6.7-mile trail officially opened yesterday. as you see, it runs from virginia street in san jose out to alviso. the $3 million project was paid for with federal funds from a 2005 transportation bill. a head's up for drivers. bike to school week kicks off tomorrow. dozens of schools are taking part in that event. that means thousands of students and parent volunteers will be sharing the roads with

drivers. bike to workday is may 9. now that the ski system in tahoe is coming to a close. the u.s. forest service is gearing up for recreation. campground beaches and hiking trails will start opening next month. but before those sites can open, they need to hire crews and staff them and clean up from winter months. some recreation openings can be delayed until june, however, because of copper theft. a disney contractor has been fined more than $60,000 after a worker was injured while cleaning a ride last november. the 37-year-old worker fell from the space mountain ride and broke several bones. state health officials say his employer violated several safety rules. disney is facing a state fine of $235,000 because of that incident. the girl scouts going high- tech with a new patch being given for video game design. the girl scouts say the patch is designed to encourage girls to pursue careers and technology in game design. boy scouts unveil a similar merit badge last month.

we have another top coming off. >> take a look at your screen. there were scary moments for fans at the drag races in north carolina yesterday. fans escaped serious injuries somehow when the body of the car driven by robert blew off near the finish line and right into the stands as you see there. officials say it happened when the engine to the car exploded. two fans were evaluated at the track as a precaution. several nascar drivers plan to show their support for the city of boston today when they hit the track. fenway racing plans to have its team carry be strong decal.

boston red sox, co-owner also has pledged to donate $100,000 for every lap the team leads during this morning's race. plans to carry this decal to honor victims. the only nascar driver or owner to have run the boston marathon. he did it back in the year 2000. the boston bombings have also hit the nascar community hard after news that the m.i.t. officer who was shot and killed is the brother of hendrik motor sports machinist, andrew collier. you can watch this morning's race, we will be ending our newscast at 9:30 to bring you nascar coverage. north vallejo are going to resume tomorrow after being suspended because of a shooting incident last week. parents and little league officials made that decision to resume games yesterday. the incident happened on wednesday during a tee ball game for five and six-year- olds. the parent of a player got into an argument and shots were fired in the parking lot. luckily, no one was hurt.

row, row, row your boat. a live look there at crew. wow, they are really going this morning. yeah, it's going to be a warm day. find some water if you can. >> five snow boarders have died in what officials are calling colorado's deadliest avalanche in five decades. it happened yesterday afternoon near loveland pass about 50 miles west of denver. authorities say six snowboarders were on the almost 12,000 foot high pass when all of a sudden the snow gave way. >> they triggered a slide. at least one of them was able to bail off to the side and partially buried, but he was able to get himself out and call for help. >> authorities say the avalanche was about 600 feet wide and 8 feet deep. right now, authorities say the avalanche danger in colorado is at a 30 year high due to a lack of snow. some people in the town of west, texas, are being allowed back into their homes for the first time since that deadly fertilizer explosion. a curfew is still in effect and

there is limited water and electricity. and many are still trying to figure out if their family and friends are okay. >> it's really hectic, but we are patient because we know the extent of damage on the other side. and we got friends and family that we don't know about over there. >> 14 people died in that fertilizer plant explosion, including 11 emergency responders, 200 more were injured. this weekend, texas is also remembering the deadly raid on the branch compound in waco. 76 people died in a fire twenty years ago, following a raid on that compound. waco and west texas are 20 miles apart and we are going to have a look at the event that led up to that waco attack after the ktvu channel 2 news at 10:00. this morning, police are searching for two people who opened fire at a marijuana festival in denver. scary if you're in that crowd. three people were hurt, but are expected to survive.

chaos erupted as tens of thousands of people ran from the denver park where that festival was being held. as many as 80,000 people were expected at the event marking the date, 420, and the passage of laws legalizing marijuana in colorado and washington state. there was a lot of people running. lots of people had different ideas of what was happening. some people yelling explosions. >> police are asking festival goers for their pictures and video. they do not have a motive for that shooting. prosecutors in the colorado movie theater massacre hope to use the defendant's own words against him. the suspect, james holmes, faces 166 counts stemming from last july's mass shooting. 12 people were killed, 70 others injured. prosecutors are building a death penalty case against him. they want to use jailhouse video and audio recordings to establish his state of mind and disprove any insanity claims. he is scheduled to go to trial next february. the death toll is climbing from a devastating magnitude 6.6 earthquake in china.

officials say the quake has left at least 180 people dead and more than 11,000 injured. tens of thousands spent the night in tents and cars as aftershocks continued to rock the region. the quake triggered landslides that disrupted communications. this morning, firefighters are gaining the upper hand on a brush fire east of los angeles. evacuation orders have been lifted for 200 homes and it does appear that gardening equipment is to blame for sparking that fire. 175-acres have burned. that fire is now 50% contained. torrential rain caused dozens of rivers to over flow their banks in six midwestern states. flood waters have forced hundreds of people to evacuate and close countless roads. rising rivers have also shut down barge traffic on most of the upper mississippi river and closed two mississippi river bridges. to the south, homeowners in

mansfield, georgia, are cleaning up a big mess after a tornado touched down. the tornado left a path of damage about 7.5 miles long in the town, ripping off roofs and toppling trees. communities have come out and helped everybody. it's been an outpouring of love. >> one woman was hurt after she was trapped in a mobile home during the storm. >> this morning, defense secretary is in israel for the first stop of his mideast trip. hagel arrived a few hours ago and this is his first mideast trip as defense secretary. he is going to meet with isreali leaders to talk about the civil war and the nuclear program. this morning he sadist reel and the u.s. are both focused on preventing iran from getting a nuclear weapon. furloughs are about to go into effect for air traffic controllers. the airline industry said there could be cancellations and delays up to two hours. air traffic controllers will be furloughed one day every other

week. a pilot's union filed a lawsuit to stop the furloughs. the court is expected to respond later this week. a coast guard cutter is expected to return after a three month deployment to the eastern pacific ocean. that cutter will return to its home port in alameda after a 181 day deployment. law enforcement crews seized more than 2400 pounds of marijuana from a boat 300 miles west of san diego. three suspects were arrested. a landmark east bay movie theater will play its final film tonight. the theater opened in pleasant hill in 1967. developers are planning to replace it with a sporting goods store. there is still some hope it can be saved and a hearing is set for next month to appeal the demolition. that sporting goods store is expected to open in about ten months. there were terrifying moments this weekend. we'll tell you what caused a

donate $100 for every lap the team leads during this morning's race. the racing plans to carry this decal to honor the victims. the only nascar driver to have run the boston marathon. the boston bombing has also hit the nascar community hard. that's after news that the m.i.t. officer who was shot and killed is the brother of hendrik motor sports machinist, andrew collier. we are going to be ending our newscast in about five minutes because we want to bring you complete nascar coverage. a project to expand the seek temple is set to break ground in just a few hours. crews will be building a new community center, museum, and performing arts center at the temple. the project was approved in 2009. several lawmakers are expected to attend today's ground breaking. target stores will give away more than a million reusable bags. they will be filled with $40 worth of coupons for green

products and about 250,000 of those bags will also have samples of earth friendly products inside. tomorrow, a plastic bag ban begins in pacifica. under the city's reusable bag ordinance, retailers will no longer provide customers with plastic carry out bags. it does not apply to produce and meat. if customers don't bring reusable bags, they will be charged 10 cents. after that, the charge could increase to 25 cents. last night, tim lincecum had one of his best starts in recent memory. shut out the san diego padres. he allowed four hits and struck out eight batters. a nice change for giants fans. and the giants won 2-0. the a's were on the wrong side of the shutout. they lost to the tampa rays 1- 0. solo home run by matt joyce. all right, it is 9:26 and let's go. rosemary did check out this
